Lots of changes! New state laws require changes by 2012. This won’t affect lands in cities and villages, only unicorporated towns.

New state rules (NR 115, Wisconsin Administrative Code) require Dane County to change, by February 2012, its regulations for shoreland development. These regulations apply to properties in unincorporated towns that are within 1,000 feet of a public lake or pond, or within 300 feet of a river or stream.

Please come to one of these meetings to learn about:
– What is, and is not, changing from the current ordinance;
– How the changes will affect how you use or redevelop your property;
– The schedule for ordinance changes, and how you can best participate in upcoming county board public hearings (scheduled for Fall, 2011).

County Planning and Development staff will give a brief presentation, and then will take questions. A summary of the most significant proposed changes is enclosed. Dane County Shoreland Zoning Ordinance: Proposed Standards for NR 115 Compliance – DRAFT 07/11/2011

What’s changing:
Small lots:
– Can build on legal, nonconforming lots as long as setbacks, impervious surface or mitigation standards are met.
– Lot sizes for offshore lots on public sewer reduced from 15,000 square feet to 10,000 square feet
– Creation of smaller lots possible through Planned Unit Development and mitigation.

Nonconforming structures:
– Unlimited repair and maintenance within existing building volume.
– Additions or expansion OK, if new additions are at least 75’ from water.
– Other expansions or additions possible with mitigation.

Boathouses:
– Mitigation required.
– Limited to 450 sq. ft, 16’ x 12’.
– No plumbing or windows.

Lot coverage/impervious surface:
– “Impervious surface” limits on all hard surfaces, including parking lots, driveways, sidewalks, patios as well as buildings.
– Up to 15% of lot OK in impervious surface.
– Up to 30% of lot OK in impervious surface, with mitigation.
– Over 30% of lot in impervious only by variance.
– Maintenance / replacement of existing impervious surfaces OK (even if over 30% of lot) if there is no net increase.

Shore cover:
– Vegetative buffer zone depth reduced from 37.5’ to 35’ from water.
– No removal of natural vegetation in vegetative buffer zone, except for viewing and access corridor, routine maintenance and conservation activities under permit.
– Alternatives available with mitigation.

Mitigation:
– State requires counties to develop measures that address “water quality, habitat and natural scenic beauty.”
– Stormwater and infiltration plan based on current county stormwater standards for redevelopment.
– Vegetative buffer zone restoration.
